Terms and fair usage policy
This Agreement is governed by the laws of the United Kingdom and complies with regulations set forth by the United Kingdom's Financial Conduct Authority (FCA) and the Anti-Money Laundering Council (AMLC).
1. Acceptance of Terms
By signing up, accessing, or using any part of the Ora Capital platform, users agree to abide by the terms set forth in this document. If a user disagrees with any of the terms or fails to meet the conditions specified in this Agreement, they are prohibited from using the platform.
The platform reserves the right to modify or update these terms at any time. Users will be notified of significant changes via email or an announcement on the platform. Continued use of the platform following such changes constitutes acceptance of the updated terms.
2. Platform Overview
Ora Capital provides an elite crowdfunding platform that allows users to pool their investments in high-risk trading, including cryptocurrency, NFTs, bullet trades, and other advanced trading strategies. The platform operates under a peer-to-peer (P2P) model and offers the opportunity for users to earn dividends based on their contributions and participation in various campaigns.
The platform is designed to maintain transparency, security, and profitability for all participants, with specific guidelines in place to ensure fairness and compliance with financial regulations.
3. Eligibility
By registering on Ora Capital, users confirm that they are:
At least 18 years of age.
Legally permitted to participate in crowdfunding activities in their respective jurisdictions.
Not barred from accessing financial services due to sanctions or restrictions by government authorities, including but not limited to the United Kingdom's FCA and AMLC.
4. Account Usage and Prohibited Activities
4.1 Single Account Policy
Each user is permitted to create only one account. Attempting to create multiple accounts for the purpose of manipulating referral bonuses, layering strategies, or circumventing platform rules is strictly prohibited. Users found violating this policy will be subject to penalties, including:
Disqualification from the platform.
Return of funds without the entitlement to profits.
Forfeiture of future dividends and rewards.
Creating multiple accounts, applying referral system abuse, or layering techniques to maximize referral rewards is considered unethical and is a direct violation of Ora Capital's terms.
4.2 Withdrawal Behavior
While the platform does not enforce strict withdrawal limits, it is strongly discouraged to withdraw multiple small amounts within a 24-hour period. Repeated withdrawals of small sums may signal suspicious activity that could raise red flags under FCA and AMLC regulations. Such behavior may result in:
Account suspension.
Return of deposited funds without the right to retain any profits.
Forfeiture of future earning opportunities until the investigation is complete.
Withdrawals that appear to attempt to manipulate the system or mask the origin of funds are in direct violation of anti-money laundering protocols and could lead to permanent suspension of the account.
5. Investment Period and Withdrawal Guidelines
5.1 Initial Investment and Withdrawal Limits
Investors should be aware that withdrawing more than 50% of their principal investment within the first 50 days may result in disqualification from the platform. This policy is designed to protect the sustainability of high-risk trading activities and ensure fairness across all investors.
Additionally, withdrawals made earlier than 30 days from the date of deposit are subject to a 25-50% fee, depending on the withdrawal amount and time frame. This fee is imposed to allow sufficient time for the capital to mature and sustain the platform’s high-yield return strategies.
Those who choose to withdraw such amounts within this period will:
1. Have their funds returned without the ability to earn profits during the disqualification period.
2. Lose entitlement to any dividends, bonuses, or rewards derived from high-risk trades.
3. Be subject to forfeiture of future trading opportunities until their account is reviewed and reinstated, if eligible.
This policy ensures that the integrity of the platform is maintained and allows us to offer sustainable returns for all participants.
5.2 Strategic Layering and Fair Usage
Ora Capital is built on the principle of fair crowdfunding. Attempts to "game" the system by creating multiple accounts or layering strategies to abuse the referral system or withdraw large amounts within a short time frame are strictly prohibited. Any detected abuse will result in immediate penalties, as outlined in Section 4.1, including possible legal action.
6. Referral Requirements and Dividend Entitlements
To maintain eligibility for receiving dividends, investors must meet certain referral requirements to demonstrate active participation in the platform’s growth.
6.1 Minimum Referral Requirement
To retain entitlement to dividend earnings, each user is required to maintain a minimum of 10 active referrals per month. Active referrals are defined as new users who successfully sign up, deposit funds, and participate in platform activities.
Failure to meet this monthly referral requirement will result in:
Disqualification from receiving dividends until the requirement is fulfilled.
Temporary suspension of rewards associated with referral bonuses.
6.2 Referral System Abuse
Attempting to recruit inactive users, creating fake accounts, or manipulating the referral system to meet the minimum referral requirement will lead to:
Immediate disqualification from the referral system.
Account suspension or termination pending investigation.
Ora Capital maintains a zero-tolerance policy on referral system abuse and will take swift action to address any violations.
7. Security and Compliance
7.1 Anti-Money Laundering (AML) Compliance
Ora Capital is committed to complying with FCA and AMLC regulations to prevent money laundering, fraud, and other financial crimes. All users are required to complete a Know Your Customer (KYC) process upon registration and must provide valid identification and proof of address.
The platform monitors transactions for suspicious activity and reserves the right to suspend or terminate any account that violates AML protocols or engages in illegal activity.
7.2 Transaction Tracking and Forensic Footprints
Every transaction on the Ora Capital platform is tracked with forensic precision. This includes deposits, withdrawals, and transfers between accounts. If the platform detects unusual patterns, such as frequent withdrawals followed by redeposits into another user’s account, this may trigger an audit. Such behavior could be interpreted as inside trading or P2P trading between members, which is strictly prohibited and will result in immediate account suspension.
7.3 Security Measures
Ora Capital employs advanced security protocols to safeguard user data and financial transactions. All data is encrypted, and the platform is protected by industry-standard security systems. In the event of a breach, users will be notified immediately and advised on the steps being taken to resolve the issue.
While we do our utmost to protect your funds, it is important to note that high-risk trading carries inherent risks, and users are responsible for understanding these risks before participating in the platform.
8. Dispute Resolution
In the event of a dispute between users and Ora Capital, or between users themselves, the following steps should be followed:
Initial Contact: Users should contact Ora Capital’s support team via email or the platform’s support system to raise their concerns.
Formal Review: Ora Capital will conduct a thorough investigation of the issue and provide a written response within 14 business days.
Final Resolution: If the issue is not resolved through internal investigation, both parties may seek mediation or arbitration as outlined by FCA regulations.
9. User Responsibility
Users are solely responsible for their actions on the Ora Capital platform. By participating, users agree to:
Act in good faith and comply with all terms set forth in this Agreement.
Avoid manipulating the system for personal gain.
Withdraw funds responsibly and in compliance with AML and FCA guidelines.
10. Termination and Suspension
Ora Capital reserves the right to suspend or terminate any user’s account if they are found to be in violation of these terms. Grounds for termination include, but are not limited to:
Engaging in fraudulent or illegal activities.
Violating referral or withdrawal policies.
Attempting to manipulate the platform for personal gain.
Failing to comply with AML and KYC requirements.
Upon termination, all funds will be returned to the user, but the user will forfeit any profits, bonuses, or rewards accrued during their time on the platform.
11. Disclaimer of Liability
Ora Capital is not responsible for any losses incurred by users as a result of high-risk trading activities. While the platform provides opportunities for growth, users participate at their own risk. The value of investments can fluctuate, and there are no guarantees of returns.
